Patrick Farm Court Decisions on 2015/2016 approvals

Unfortunately, but not surprisingly, on June 30th, Judge Walsh handed down decisions allowing the latest Town Board and Planning Board decisions to stand.  The 2015 Town Board decision was related to  the Town Board’s refusal to require supplemental environmental review of the project as result of the applicant failing to disclose over 40% of the federal wetlands and waters on the site.  The 2016 decision was related to the Town Planning Board's 3rd approval of the Final Subdivision and Final Site Plans for the project. New ULI Wetland Petition Sent to DEC

One of the most time consuming and costliest ROSA projects this year was work spent on coordinating and supporting a new municipal led petition to the NY State DEC to ask that the western wetland system on the Patrick Farm site be added to the NY State DEC Wetland Maps due their Unusual Local Importance ("ULI"). It seems discouraging when the Planning Board rushes through the review process and just approves again plans which are not ready for approval. This was done yet again this past January but remember this isn't the first time this has happened. ROSA fought the final decision made in 2012 and again in 2013 and both times the developer was forced back to the planning board. This fight is still being fought and here is an update.
