New ULI Wetland Petition Sent to DEC

One of the most time consuming and costliest ROSA projects this year was work spent on coordinating and supporting a new municipal led petition to the NY State DEC to ask that the western wetland system on the Patrick Farm site be added to the NY State DEC Wetland Maps due their Unusual Local Importance ("ULI"). On August 29, 2016 the Village of Pomona submitted a new Petition to the NYSDEC requesting that the wetlands be added to the NY State maps under a statutory provision that states that wetlands hydraulically connected to an aquifer used for public water supply are to be designated NY...

This was done yet again this past January but remember this isn't the first time this has happened. ROSA fought the final decision made in 2012 and again in 2013 and both times the developer was forced back to the planning board. This fight is still being fought and here is an update. On January 26, 2016 there was a planning board meeting with a public hearing held after a number of December maneuvering by the developers getting several Town Board...

Findings Addendum September 17, 2015

At 9:50 am, Bill Weber called Deb Munitz just ten minutes before the Town Board meeting of September 17, 2016 asking if she knew that Patrick Farm was on the agenda. No, nobody knew. Deb Munitz ran over and caught Michael Klein asking why there was no notice and the answer was straightforward, there was no public hearing planned so that board did not have to alert the public. After years of fighting and extensive litigation regarding the plans ROSA had forced the developer to have to go and get a Jurisdictional Determination from ACOE and this finally was obtained in December of 2015 so new...
